Welcome to Tinch Jewels. These Terms and Conditions ("Terms") constitute a legally binding agreement between you (the "User," "Client," or "Customer") and Tinch Jewels. By accessing, browsing, or executing a transaction on our platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. Please review them thoroughly before proceeding.

12.1 General Framework

  • Ownership: This website and all associated services are owned, managed, and operated exclusively by Tinch Jewels.

  • Policy Modifications: Tinch Jewels reserves the right to amend, update, or restructure these Terms at any time without prior individual notice. All modifications become effective immediately upon their publication on this page.

  • Implied Consent: Your continued use of the platform following any structural or policy revision constitutes absolute acceptance of the updated Terms.

12.2 Eligibility for Use

  • Age Restraint: To access our platform, register an account, or complete transactions, you must be at least 18 years of age.

  • Legal Capacity: By utilizing our services, you affirm that you possess the full legal capacity to enter into binding contracts under the Indian Contract Act, 1872, and other applicable statutory mandates.

12.3 Product Specifications & Pricing Structures

  • Currency and Taxation: All retail prices displayed on our platform are denominated in Indian Rupees (INR) and include the applicable Goods and Services Tax (GST) unless explicitly stated otherwise.

  • Payment Gateways: Financial transactions are securely executed through certified third-party merchants, including Razorpay and PayU. We accept UPI, verified credit/debit cards, net banking, and approved digital wallets.

  • Cash on Delivery (COD): Partial COD facilities are available exclusively for eligible orders up to a maximum threshold of ₹99,999, subject to the conditions detailed in Section I (Payment Policy).

  • Price Adjustment Rights: Tinch Jewels reserves the absolute right to alter product prices at any moment due to market volatility in precious metals or gemstones. Formally confirmed orders will be honored at the specific transaction price recorded at the time of confirmation.

12.4 Order Placement & Formal Acceptance

  • Offer to Purchase: A finalized digital order submission constitutes an offer by the client to purchase the selected items. A binding sales contract is executed only when the order is formally processed, verified, and handed over to our logistics partners for dispatch.

  • Order Rejection Protocols: Tinch Jewels reserves the right to cancel, limit, or refuse any order at our sole discretion due to technical anomalies, systemic display errors, pricing inaccuracies, material stock depletion, or alerts flagged by our internal fraud mitigation and risk assessment teams.

  • Cancellation Payouts: Refunds originating from company-initiated cancellations or order rejections will be credited back to the original source account within 15 business days.

12.5 Shipping Logistics & Title Transfer

  • Insured Transit: We provide fully insured delivery solutions across serviceable postal codes within India through specialized premium logistics partners.

  • Indicative Timelines: Stated dispatch and arrival parameters are purely estimates. Tinch Jewels remains absolved of liability for delivery disruptions arising from third-party courier handling constraints or customs holds.

  • Transfer of Risk: Legal title, proprietary ownership, and the risk of loss or damage transfer entirely to the customer the moment the package is delivered to and signed for at the nominated shipping address.

12.6 Summary of Returns & Refunds

  • Return Period: Requests for standard item returns must be formally registered via your website user profile within 7 calendar days of delivery.

  • Handling Charges: The customer bears all reverse logistics expenses. A processing and reverse shipping fee of ₹1,000 to ₹2,000 applies to Tier 1 and Tier 2 cities, while remote regions (Tiers 3 through 6) incur actual logistical expenses up to ₹5,000 per side.

  • Quality Mandate: Payouts are contingent upon the returned item passing a rigorous internal Quality Assurance assessment. All laboratory grading certificates, branded packaging, and original security tags must remain completely intact and untampered with.

  • Exclusions: Transaction merchant fees and outward shipping costs are strictly non-refundable. Custom-made, bespoke, or personalized creations are entirely final sale and excluded from standard return terms unless an inherent manufacturing defect is confirmed by our technical team.

12.7 Lifetime Exchange & Buyback Programs

All post-purchase upgrades, trade-ins, and asset liquidations are governed strictly by the separate terms, valuation equations, and lock-in windows detailed in Section VI (Lifetime Exchange Policy) and Section VII (Lifetime Buyback Policy) of this document.

12.8 Intellectual Property Protection

  • Proprietary Rights: All structural layouts, trade names, registered brand logos, custom jewelry designs, text copy, graphic arrangements, photography, and underlying source code hosted on this platform are the exclusive intellectual property of Tinch Jewels.

  • Usage Restrictions: No individual or entity is permitted to scrape, copy, replicate, distribute, broadcast, or commercially exploit any content from this platform without explicit prior written authorization from Tinch Jewels.

12.9 Prohibited User Conduct

By engaging with our digital platforms, you formally agree to refrain from:

  • Executing fraudulent, speculative, or bad-faith transactions.

  • Deploying unauthorized code, malware, or digital architecture to compromise our servers, databases, or user information networks.

  • Systematically exploiting or abusing our promotional codes, return structures, exchange programs, or buyback frameworks.

Tinch Jewels reserves the right to permanently revoke platform access and terminate accounts found violating these conduct provisions without prior notice.

12.10 Limitation of Liability

  • Exclusion of Damages: To the maximum extent permitted by applicable law, Tinch Jewels, its directors, employees, and suppliers shall not be liable for any indirect, circumstantial, incidental, special, or punitive damages—including but not limited to loss of data, anticipated profit margins, capital revenue, or corporate goodwill.

  • Liability Cap: The cumulative aggregate liability of Tinch Jewels for any legal claim, dispute, or breach arising from a platform interaction or purchase shall be strictly capped at the exact financial amount paid by the customer for that specific order.

12.11 Force Majeure

Tinch Jewels shall be completely absolved of any failure or delay in fulfilling its operational obligations if such deficiencies arise from events beyond our reasonable control. These events include, but are not limited to, acts of God, extreme weather anomalies, labor strikes, civil unrest, war, sudden legislative or government-mandated lockdowns, cyber-attacks, or systemic regional failures in telecommunication and shipping infrastructures.

12.12 Discretionary Case-by-Case Reviews

For complex client scenarios or operational ambiguities not explicitly codified within these Terms and Conditions, we invite you to connect directly with our Client Care Concierge. Tinch Jewels is dedicated to addressing individual client grievances with immense care, fairness, and structural discretion. Each unique scenario will undergo an isolated review, and resolutions will be determined on a strict case-by-case basis.

12.13 Governing Law & Legal Jurisdiction

These Terms and Conditions, along with all operational and transactional frameworks, are governed by and construed in accordance with the laws of the Republic of India. Any legal actions, proceedings, or unresolved disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra.
